Bird Rock Bandits Case: Preliminary Hearing Decision This Week

The criminal case surrounding the death of pro surfer Emery Kauanui at the hands of five men in La Jolla, known as the Bird Rock Bandits, reaches a critical juncture this week.

Seth Cravens, 22; Eric House, 21; Orlando Osuna, 23; Matthew Yanke, 21; and Henri “Hank” Hendricks, 22, were arrested last year in connection with the death of Emery Kauanui Jr., 24, who cracked his skull when he fought with others outside his La Jolla home on May 24.

Kauanui died at a hospital four days later.

Judge John Einhorn, who is presiding over the preliminary hearing, will decide this week if there is enough evidence to go to trial. More importantly, has sufficient evidence been presented to order the defendants to stand trial on murder, assault, battery and gang allegations. A crime that involves a gang can ratchet up sentencing guidelines for the convicted.

To determine if the group was acting as a gang certain criteria need to be met. The California statute under which street gangs are defined, California Penal Code section 186.22, is very loosely worded.

The statute defines criminal street gangs as:

"Any ongoing organization, association, or group of three or more persons, whether formal or informal, having as one of its primary activities the commission of one or more of the criminal acts [contained in the statute] having a common name or common identifying sign or symbol, and whose members individually or collectively engage in or have engaged in a pattern of criminal gang activity."

This is a fairly broad designation and one open to various levels of interpretation. Using the above definition one could conclude that the convicted Enron officials were gang members.

Prosecutors have brought experts and evidence in the preliminary hearing in their attempt to prove the Bird Rock Bandits are in fact a gang. One expert witness, an investigator for the San Diego District Attorney's office, said the Bird Rock Bandits showed all the characteristics of a gang including claiming a territory, displaying hand signals, the use of gang defining colors, and most importantly, ongoing criminal activity as a group.

After Kauanui's death, crime victims in the La Jolla area have come forward to make statements with the investigators claiming the Bird Rock Bandits assaulted them.

On the defense side, attorneys attempted to dissuade the judge by offering that the hand sign the men displayed are the same one President Bush displayed at a Texas Longhorns football game. The so-called colors that the Bird Rock Bandits wore on their clothing were in fact the colors of the local high school in La Jolla that the men attended.


The alleged gangs' territory, La Jolla, is one of the wealthiest areas in California. A one-bedroom condominium sells for upwards of $1 million. The shock and dismay that a gang would fester in such a wealthy community has drawn significant attention to the case. Internet messages boards have heated up since the preliminary hearing began. On SignOnSanDiego, a blogger wrote, "the Bird Rock Bandits clearly held themselves as a group and apart from other "average" citizens, and, used that position to intimidate, assault, and/or cause harm to others who didn't fit into their of-the-moment group mentality."

While another voiced this opinion, exemplifying the polarizing effect this gang characterization is having on the people of San Diego community, "the first person to start throwing the word "gang" around is, you guessed it, the D.A., trying to sway the court of public opinion to her side, play on the public's emotion, get all the defendants to stand for the murder charge…this case will wind its way through the trial courts and then the appellate courts and come right back into san Diego with the same results: more mud on the DA's face, (and) a finding of no gang affiliation."

I don't want these guys in my community. I have been living in and surfing La Jolla for over 16 years. I can't believe this article is stating that the notion that they could possibly be thought of as a gang as being ridiculous. Just because these kids are white and live in a wealthy area and not mexican or black or asian and poor doesn't mean that they don't fit the definition of a gang. A friend of mine has a son that knew these guys in high school and after this happened, he said "those guys were always bad news in high school." They killed someone, that many had said was a beautiful person. Emery's hands weren't even damaged. He didn't try to hurt any of them or maybe he didn't get the chance to defend himself. It breaks my heart to hear about monsters that kill or mame innocents.

For real, Jeff. I live and teach in San Francisco, and any kids of color who claim a crew, throw signs, tag their crew, any of that shit, would be subject to gang injunctions and forbidden from being out of doors in their own neighborhoods. That the editors of this forum think this is up for debate makes me sick to my stomach. These fools should be hit with gang enhancements and sent to jail to kick it with those people that they so badly wanted to emulate. To quote Hunter Thompson, I shit down the throat of these swine.

Why would there be such shock and dismay that "a gang would fester in such a wealthy community" when there are plenty of drugs, alcohol and sense of power and entitlement in this community. I have lived in La Jolla for almost 15 years and all is not what it seems to the outsiders. Several weeks before their fatal attack, I witnessed the aftermath of a bloody beating where several of this same group attacked a stranger on the street. These guys are thugs and deserve the full extent of the law. It infuriates me that people are trying to whitewash this incident. The death may have been accidental, their history of violence is not. Facts are facts... deal with it!

This trial is a tragic lesson for the entire surf community, globally. Look, i doubt that these guys intended to actually kill anyone. But the brutal reality of life is that you never know what door you are opening when you start a fight. it is a far more serious act than most of us would think. Sure, in the entertainment world fighting is commonplace, and the hero always wins, etc. But that is not the real world. In the real world the pain is real, and death is final, and so are its ramifications. 5 minutes of mayhem can mean a lifetime wasted in a small cold cell, and parent's dreams broken like glass. I hope these guys rot in jail. They should sit in a cell with nothing so that all they can think about is what cowards they are. Five guys on one guy. They must be hard core, NOT. Would love to see what these guys would do in a one on one situation, probably not much at all. Hopefully our judicial system will not let Emery, or his family, down. I lived in Diego from 1989 to 2004, surfed for the last 12 yrs of that time, and had my run ins with plenty of idiots like this. I wonder how tough they will be in jail? Guarantee that these guys will be crying for the first month they are in jail. Nobody to back them up in there. I am sure that they did not mean to kill him, but they did and now they must pay with their lives. What is wrong with this country that gives criminals like these any rights. Throw them in a cell with nothing and let them feel that for 50yrs. better yet make it life. Emery is not alive, why should these cowards have an opportunity to ever get in the water again.

I knew Emery when he was like 15 and he had a real love of surfing. I is a waste that this happened. I does not matter if they are a gang or not they should beaten and flogged then at least a life sentence if not more! A comparison to the Duke Lacrosse case isn't really fair, considering in this instance a man was undeniably killed by the accused. In the since of misguided privilege, yes. But widely-regarded false accusations and dis-barred DA's versus murder is a whole different story.

I think many people are missing the main theme of this tragedy. This type of thing has been happening around the country for the last few years. From Columbine to Virginia Tech, and the mall in Omaha. There is obvoiusly not a clear enough message going out to our youth that violence is not cool. There aren't gangs in La Jolla, just kids who think they are tough. The responsibility lies upon the adults of the community and their ability to communicate with our youth. We are obviously not successful at this point in time.

I am from the suburbs of south san jose in norcal,have been in sd since 10 years now. I ran with the wrong people when I was a kid and went to juvi a couple times for bad decisions I made. There,I was hanging with true gangs.Crips, bloods,nortes,surdenul and vietmanese gangs! yadadadada. These dipshes are not gang members. They are little bishes who thought they were tough, cool local surfers fa66ot kids! To all those who think these are surfers, you are wrong. To those in south mission who think you are cool local surfers. WAKE UP! The ocean is a place to be free! These KIDS made some bad decisions and now they have to pay for there crimes. First, based on a reading of the statute I would find it hard to believe that the judge would find in the preliminary hearing that these men did not act as a gang. The statute is written broadly to be able to catch such heinous acts as what happened to Emery. Second, even if the court finds no grounds for a finding that they acted as a street gang, the men will still be charged with first degree murder. Their attorneys will attempt to argue lack of intent and premeditation, but this argument will fail. They hadintent to beat him and even if they didn't intend his death the intent to inflict harm on his person satisfies the requirement for intent under the law. Unless there is a stupid jury these men will go to prison for life.

I was just a Foreman on a Jury for the last 8 days regarding a Vietnamese Gang attack 10 on 2.The Defendant was seen by 3 of the witnesses/ victims as only cursing and telling the gang to stop because the cops were coming.The definition of aiding and abetting (accomplice) a crime is: anything someone does that facilitates, encourages, promotes, or assists the said action. He didn't have to be the one who pulled the trigger. The LAW states that the person who aids and abetts is just as guilty as the person who does the act. You have to go by the LAW not your Personal Biases. BUT, put 12 of their "PEERS" on and JURY and it gets ridiculous. The Defense will have them attending church and reading to the blind 3 nights a week. Those perfect Angels could never have done something so heinous.... Let's Pray that the Jury isn't blind and Justice will prevail. By the way that kid was 22 - same range as those Turd Rock Faggots. Lets hope they had a couple priors and a few ommissions in the

the DA has only documented 12 fights possably attributed to one or more of these young men in the last 4 years... that's 3 possable fights in 4 years... with zero positive id for the majority.. this whole case is speculation, would you put away your child for life in prison because it could be speculated that they were in a gang? out of the 5 men, none have a criminal history, the only person who happened to have a criminal record of starting fights was emory himself...

The argument of whether those f-heads are a gang is pointless, their actions speak louder than their words ever will. I currently live in Hawaii from San Diego. When I read the story of the Hawaiian surfer Emery I was embarresed to be from San Diego. La Jolla is a privleged community with just as many screwed up kids as the ghetto. I feel for the family and his friends. I hope justice is done and $$$$ from La Jolla will not change the outcome of these losers, they will pay one way or another. I hope they don't ever plan to go to Hawaii and surf real waves.

as pointed out by others, just because they are white and from wealthy families, does not exclude them from being considered a gang. just because they do not have prior convictions, does not mean a thing. they've intimidated the community and were slick enough to get away with things for some time. they promoted themselves as a gang in their attitude, myspace, graffiti, hand-signs, and of course, their incredibly consistent history of violence. lets not forget also, that these were very large football/athletic guys who attacked as a group a way smaller/skinny young man. our culture has changed. gangs have myspace pages and come from well to do families. they need to be tried and convicted as the gang members that they are!!!!!

Having grown up around and in gangs, these fools could be considered a 'gang'. They are a group of the same guys that hang out together, no issues so far. But they have staked out a territory, La Jolla, and have committed criminal acts. Makes them a gang. A weak sorry excuse for a gang, but a gang nonetheless. Just because they are in La Jolla means nothing. People getting together for criminal acts does not know any social boundaries. The only reason this 'gang' has any kind of 'power' is that the majority of La Jolla are not used to dealing with anything 'rough' and the BRB take full advantage of that. But you take BRB and put them in Southeast San Diego or Logan Heights, their gang status will last about as long it takes to beat them down. About 5 minutes. They thought they were being cool by banding together and intimidating people who are not used to that kind of stuff. They are in for a rude awakening in prison

You do not know the real story, some of these kids did not live in town, they were away in college emery had no marks on his body so that no one ganged yp on him ever ; the only blows were one to the jaws and the other was falling backwards on the concrete showing that noone beat him up whiele he was down he beat eric house and seth craven gave him a puch end of story, read the court papers the autopsy shawed no traumas at all except for these two

If you have any doubt that these guys are a gang ask yourself this: If you were walking alone at night and this group of guys decided to beat you up (for no reason) what would you call them then? Of course they are a gang. They deserve more time than they are getting (about three yrs. a piece after the plea, June 28, 2008). Just because they are white doesn't mean they get to beat the hell out of people and walk away scot-free.

Where did these guys go wrong? From birth if they we in any other town would it happen this way? I have to believe that everyone wants to love and be loved, I just don't see how any kids can get that far off the path. Because they isolate themselves and feed each others ego maybe they trick each other in to believing making other suffer is the answer to their pain. Maybe this is why youth gang are so dangerous. I just know the more I look at this the more question I have.

This is a classic example of rich kids thinking they own the world and people because they have money, all of those losers felt the need to beat up one guy to feel power I think they were jealous because he was so much better looking than them and was getting all of the girls and attention. Rich kids have no purpose in life other than living off of mom and dad prime examples, Heidi and Spencer, Laguana Beach children, The Hills rejects, the children on "Sweet 16" a bunch of spoiled brats walking around judging people that aren't in the same class as them and not acting with much class at all. These rich kids are nothing but "TRASH WITH CASH" look at the behavior dlrrping around partying too much and working way too little!
