TRESTLES TOLL ROAD SAGA: Thousands Attend Federal Inquiry In Del Mar

by Alex Wilson
Associate Editor

View pictures from the hearing here.

The second option is definitely worse.

We’ve been here before, sort of. In February, roughly 3,500 toll road opponents and supporters showed up at the Del Mar Fairgrounds to voice their opinions in front of the California Coastal Commission. Back then, the commission denied the Transportation Corridor Agency permission—by an 8-2 vote—to extend Route 241 sixteen miles, part of which would run through San Onofre State Beach.

View pictures from the hearing here.

So, why another hearing today? Another crowd at the Del Mar Fairgrounds—this time estimated at about 2,500 at its peak—waving banners, jeering, and whistling in protest and support?

Well, now the Feds are involved.

After the TCA was denied permission to build the 241 extension, the agency filed an appeal. And since a portion of the road would run across federal land, the U.S. Department Of Commerce was brought in to hold another hearing…and make another call on whether the TCA can build their road.

Hundreds of public speakers, “experts,” and pundits signed up to testify today in front of the federal panel, however, due to time constraints only about 150 were actually given the opportunity to speak. Elected officials and speakers representing local government, business, and environmental organizations were given priority at the pulpit. The result: very few private citizens were heard.

The hearing’s structure also allowed an even representation of argument for and against the road, despite the fact that the majority of those in attendance today were in opposition to the proposed extension. (One public speaker estimated the ratio in the crowd at about 3 to 1.)

The Department Of Commerce has the ability to overrule the February decision made by the California Coastal Commission. Regardless of the demonstration at today’s public hearing, however, they are not required to make a final call until January 7, 2009. The funny part (or frustrating, depending on how you look at it and where you stand) is that no matter how the Department of Commerce rules—whether they decide to allow the TCA to build or not—it’s likely the whole thing will end up in either federal or state court and tied in legal litigation. “We’re nearing the end of the line,” said CJ Olivares, chairman of the board of the Surfrider Foundation and GM of Fuel TV. “There just aren’t that many more places this thing can go.” Translation: today’s Part II was a cliff hanger. So get ready for Part III, which finally conclude in court.

I know the pro-toll road "effort" will not stop! Too much money backing it. The only thing that will truly stop it is a realistic and viable alternative. That's the trick! That means someone needs to be able to make "money" while somehow providing the solution! What the Republican/Right/pro-toll road folks want are jobs, no traffic and income for the state! That is a noble and necessary fuel for our economy and lifestyle. What the Democrats/Liberals/Left/anti-toll road folks need to provide is an alternative to freeways/toll roads that will accomplish that.

We can cry and scream our "eco messages" all we want, but the hard, cold reality is we still need to provide jobs to citizens and a way for them to get to their jobs in a reasonable/timely way. We are a "free enterprise" country, for better or worse. No jobs and our nice SoCal lifestyle all goes to "hell-in-a-hand-basket". As that happens funding for pro-environment efforts and state parks are the first items to be cut out of the government budgets. Next goes the education budget and we just get stupider and this whole cycle repeats endlessly. We need to match (or beat) the Republican machine at it's own game... solutions that create jobs, provide traffic relief and do it without environmental damage, period. If we can't supply that... well, the Republicans will, sans the environment element!

We (future-thinking people) all know that the oil-economy is doomed, that building freeways is short-sighted and that mass-transit (real, intelligent mass-transit) is the only answer to keeping a quality of life/environment sustainable in California... or the world for that matter. Cars will not go away, but I believe that once people start using quality mass-transit (hey it works in DC and SF...) they will wonder why they ever suffered through the horrors of the car commute. And we establish real alternative, emissions-free fueled cars and therefore more new industries (JOBS!) and less pollution with less traffic! Oh, did I mention, less need for toll roads and new freeways. Throw in more forward thinking effort by we the citizens ourselves; using our cars less right now (riding your bike, taking/supporting existing mass-transit), telecommuting (ask your boss!) at least one or two days a week... to start.

The fight has only just begun and I think the "pro-toll road" folks have been letting this "Dog" lie to lull us "anti-toll road" folks into complacency. They are gearing up for a big fight with lot's of help from the government. Know this; People all over are losing jobs, and this project will promise new jobs. That will be another big carrot they will dangle to get leverage to move forward. Arnold is already moving players around on the Coastal Commission (and other boards) to help his cause. He wants jobs and tax dollars so, his motivation is clear! Keep the pressure on and don't let the good folks forget that the fight ain't over, and in-fact, has only just started! There's a storm a comin! Keep the message out there, but we better have an alternative to present or it's all for nothing. STOP THE 241 EXTENSION!!!... with answers of our own that make sense! END-

The argument about creating union construction jobs is a silly one. Lance McClean, the CEO of TCA, even said expanding the 5 would create twice as many jobs. If you were not there, please watch Steve Blank of the Coastal Commission get REAL answers from McClean himself!!!! If this youtube link doesn't work search Coastal Commision on TCA, and watch the 4 video parts. Basically, Mr. Blank gets McClean to admit 5 of his proposals are BS!! haha http://www.youtube.com/watch?v=Z7Bdf2a1Psw&feature=related

A huge Mahalo to everyone who showed up at Del Mar II yesterday to fight to protect our state parks and our coast and ocean. San Onofre State Beach Park should not and cannot be divided by a private toll road. Once again I was blown away by the passion and energy of the Save the San Onofre Coalition. I was stoked to see all of the groms who attended as well. This is far from over and in the end we all need to understand that state parks are off limits. All the talking points and PR from the TCA won't change that fact. Serge Dedina, Executive Director, WiLDCOAST

You all should be more concerned about the Marines completely shutting down access to trestles and the portion of the park that is south of the freeway for "security reasons" and "maneuvers". This will not only cut off access to the portion of the park that is used by the majority of the people, it will take away trestles, and something building the 241 1/2 mile away will never do. Think it won’t happen? Think again. The road will be built, despite all the lies from the anti-road crowd.

It's not about jobs, or messing up a Trestles. It's about preserving our natural wonders that have been set aside for a reason This is a State Park people for all to enjoy! Last I checked toll roads are for the rich who need a short cut around the traffic that plagues Southern California. Take 73 toll road and you'll see what I mean, great short cut for 4 or 5 bucks with no traffic. It's a rich mans highway. Don't be fooled.

From the Republican point of view IT IS about jobs... and money... and taxes. This project will create jobs! A big selling point to all the folks who are in over their head on mortgages etc. If a person is about to lose their home and the kids gotta eat, they will take that job. They will pay taxes. The government will make its money and that is what we are up against. Very powerfull forces. Do not under estimate them. We have to provide a better solution to counter the needs of this economic monster that So Cal has become. If better ideas are available, then we need to be better at presenting/promoting them. It is more about money/jobs than traffic solutions! Surfrider, Surfer Magazine, Wildcoast, Sierra Club et al, show us a better viable solution we can promote; Hire an industrial engineer to show how rail/mass trans is better, more viable, green and can create jobs. The eco message is good, but not enough! We need to be smarter than the pro toll road folks!

Come on, what are you from Berkeley or something? This has nothing to do with "Republican/Right/Pro-Toll Road folks". I'm from south orange county, I regular surf Trestles, take my family camping there, I'm as conservative and Republican as they come, and am vehemently opposed to this toll road. So please leave your Republican barbs for your myspace and lets join together and stop this mess. Perhaps you can even get your elitist Hollywood friends to help us out ;-) Or your uber wealthy Algore to pony up some support. Sorry, couldn't resist.

gas prices are dropping, max. also, while you may delay it, development is here to stay, particularly in the OC, even if there's bells verio or whatever pocket mice there. Just wait until McCain is pres - the endangered species act will see its death blow. Mass transit in SoCal will never work - the people of OC alrady made it clear that they don't want it and the costs associated with it are so much higher than you can stomach that it's not even funny. We're build for cars in SoCal and it isn't EVER going to change. Hold on to your little temporary victory at Trestles - the Toll Road will happen no matter how much you fight it. And, guess what...the surf will still be there.

We should not be paving over anything in Southern California that is not already paved over. I grew up here and remember starfish, crabs, horned toads, etc. that are now rarely seen. Trestles is as precious as Yosemite. Environmental technology is a growth industry. The sooner we embrace it, the betteer chance we'll have of competing globally. California has a tradition of innovation, (surfing, Hollywood, Silicon Valley.) We don't have to do things the same old way. Thanks to all the brothers and sisters who showed up at Del Mar.

Now that Del Mar is over, What can we do next? We've got to stop this bloody toll road. I'm so sick of people trying to pave more of OC, the non paved areas we have are so precious. Why would anyone want to pave it more? I guess those who don't live anywhere near here. We WILL stop this, we've done great so far.

The Trestles issue should not become a political debate. My being a republican does not change the fact that I think ruining a historic beach and break is wrong. A suitable alternative is definitly the right answer, and even though the solution should fall on those planning the road, let's face it, if the solution isn't put forward by the opposition (that's us guys) then those with the deepest pockets WILL win, we've all seen it before. Although I reside in Florida, the Trestles debate hits home on many levels, passes, estuaries, and sealife take a back seat to development here as well. It's time people from both sides of the aisle, especialy surfers, form a united front against developing protected and historical land nationwide. Boom..Outa here

These times are tough and this isnt the United States of America either. The whole country is in trouble financially. The big guys lined their pockets and the ordinary American is going to suffer. The surfer who enjoys the Trestles wave is up against incredible odds and I cannot believe that so few have taken to the streets to stop the madness. Remember the Dana Point harbor mowover? I was not here for that takeover, but Im sure it will be just as disheartening. I surf daily and didnt ever know about the Del Mar meeting. This is not working. I would have supported the cause had I been informed.

Why is this becoming at Democrat VS republican issue? No wonder why nothing gets done in this country, 2 sides can support the same issue and the one gets thrown under the bus. I was surfing Lowers Tis AM and there were 8 of us out. I knew all 8 guys, guess what, most, if not all, are Rebublicans and actually ENJOY trestles and are against the toll roads. PLENTY of republicans in South OC and north SD counties don't want to see this thing go through, so stop generalizing. This state is hardly run by republicans. People need to focus on supporting each other rather than dividing.

i don't understand why people are making this out as a left/right, dem/rep issue. this is almost strictly a california issue, environmentalists-vs-capitalists. it's not about which pres. candidate you support, neither of them are gonna do shit for trestles. i'd be surprised if they even knew what trestles is. also, this isn't a decision being made by legislators or executives (gov't), it'll be made most likely by a judge or panel of judges. but here's an idea, it wouldn't be all about dollars if california wasn't broke. solution: or at least a good start, stop giving californians hard earned tax dollars to ILLEGAL aliens in the form of welfare, it should be illegal for the gov't to give your dollars to people who don't belong here. Don't call me a hater yet, i'm not against immigration at all, in fact i think it's critical for us to have immigration. i'm just saying that they are breaking laws by being here, and we're paying them for it.

My point was not initially that this is a Republican versus Democrate fight. I know PEOPLE on both sides and the stance is NOT divided accordingly. The fact does remain though, that the Republican agenda is overwhelmingly pro development. Do some research here (beyond your pals in the water) and you will find that the power mongers (big businesses and big government) and the influential (Rich) who favor the toll road are Republican. 100%? No! But majority? Yes! Redcounty.com and lincolnclub.org are good places to start. These Orange County based Republican groups will push development over nature every time. Except NIMBY! I agree that we can make a better solution by finding common allies/ideas on both side than to be partisan. My main point is to find a better solution (fast) and present it. The surf/environmental media must produce and present this to the public at large. If not, we will continue to sound like a bunch of backward hippies with nothing to contribute to progress. Yes, progress can be good to

I am a Rebulican but I understand completely not wanting to destroy more SoCal beaches and parks. I spent many a year surfing SoCal beaches and breaks. It is more than just about money. It is about quality of life. I have a suggestion that might work rather than building another road. I don't live in SoCal anymore and I have wanted to come back for years. Recently, I did a study to find out if the the train networks stop at any SoCal airports. I work for an airline and my study was primarily linked to living inland and commuting by rail. The only rail service to any SoCal airport is to San Bernadino airport. Instead of building another road why don't we exploit the systems we already have in place. Imagine rail service from LAX or BUR or SNA to downtown or other major location. Remember the elevated rail system at Disneyland? (Not the people mover) What a tremendous boost to the economy that would be. The coastal train is great! Let's expand that first, then build a road if we need it.

we're so f'd... this is a case of the higher ups bullying us around... we already defeated this initiative, why is it even going through these various channels, and since it does cross federal land, does that mean that their jurisdiction is partial? this is BS. I wish I had money to burn like these guys.. they're privitizing roads, taking our money, and ruining our planet... Remember this is not a public project, this is a project for profit, so they've done the math, and its worth them to pursue this... it's not to releive conjestion, its not to create jobs, it to put money in their pocket, they're not going to pay the employees well, and its not going to benefit the local community.. This is a capitalist project on the international level, these guys are an international company, and they own tollroards everywhere, they could care less about san clemente, and about us... Remember, this is a for profit project

Yes, Goofyfooy, that is correct! It is the higher ups bullying us. It's not about traffic, it's about jobs, business, commerce, and if it means a sacrifice of the environmnet... well so be it! That is where I part ways with the current republican machine. Creating jobs is good, but it's proven hard to do without some destruction. But, with some new thinking and innovation we can correct that old school mentality. But big business is short sighted and impatient, as they want profits (nothing wrong with that) and they want them now. So, it's on to the same well oiled (no pun intended) path that we have been on for the last 50 years...business as usual! Don't innovate, just make a profit and do it quick. So they will side step any environmental impact reviews, safety studies or anything else that will slow down or halt their "progress". Those systems, that they like to call "road blocks" are actually regulations-another nemissis of the Republican machine. They puposely slo

CONT. FROM ABOVE: They purposely slow the process down so we can do studies to make sure projects are safe, do no environmental damage, and, yes, turn a profit. Most of the projects of this scope are funded by banks, corporations (or even governments) far away. And they could give a rats rump about saving nature or hurting people. Their names are not on the project, so the entity that is doing the funding has no public liability at all. So, they holler go go go! And try to ram the project through as quickly and quietly as posible. Just turn a profit! There is a reason for regulations, just don't tell that to a Republican hard-liner. So that is why we must have a loud voice to oppose this project. But the voice has to be one of reason. We can't stop progress-and shouldn't. But we can be smart about it. So we, with the opposing voice must lead the way with a better idea, not just bullheaded opposition. I, again, charge the enviromental media to publish, loudly and clearly, better ideas... quickly!

Higher unemployment and people pissed off about the economy=way too much time to protest shit that would actually improve the economy and more wasted time you should be spending getting a job. Have you ever seen what crabs do in a bucket?
Posted Thu Sep25, 2008, 5:51 PM — By frankLor
We are crabs in a bucket...too many! There are way too many of us to sustain a continued quality of life here in SoCal. The train has to slow down or switch tracks. Look at all the SoCal development that has gone on in the last 30 years. This place used to be beautifull. Now it's paved, overdeveloped, landscaped and homogenized lifeless (excluding the human masses), stripmall drenched drive through that only looks good on TV and the tourist brochures. But, if we don't contribute an idea that is better and smarter, it's gonna continue, than we can kiss it all goodby! And all we'll here is the echo of our whining! Once a toll road is built, there is no "Undo" buton. And whatever was there before is gone forever! Animals, plants... open space... Stop griping and present a better idea. What's your daily impact. Reduce, reuse, recycle is a great personal guide and should begin with all of us yesterday. But we have to face the real world. 99% of us drive cars to surf Trestles! What p

CONT: What part will you play to make a REAL difference. Joining the Surfrider Foundation and all the other enviro groups is good, yes. But we need to be active in the way WE live our daily lives. Look in the mirror and what do you see? Are you really walking the walk you ask your enviro groups to promote? When you leave the water to go back to your car (!) do you P/U all the trash along the way? Do you ride your bike when you can? Car pool? Buy organic? Support limited packaging products? Just spend a couple of weeks or even days looking at how you really live your life and then look in the mirror and ask: Am I part of the solution or part of the problem?

Guys like Franklor act they do something when they are a bunch of noisy crickets waving the big rainbow flag as the steam roller mashes them into the pavement. Trestles is a surf location near an area where transportation is needed. What don't you get? Surfers are owed nothing. Their needs account for less than 1% of the populous. Go back to the bong.
Posted Fri Sep26, 2008, 2:13 AM — By FrankLor
Stewart, I agree with you that transportation is needed. But it does not have to be the same old destructo policy of slash burn, pave and build more so we have to slash burn and pave, ad infinitum... Look around at this aproach for the last 30 years and see where that has gotten us. Don't know about you, but I don't like what I see. And to endlessly repeat this is lunacy. We surfers are not owed anything but the open spaces and animal life are. We cant stomp out all the nature and life as we see fit, just cause we are too lazy to stop and think about more effective and less damaging alternatives. I'm not a hippie, I take my responsibility as a citizen seriously. I act by living as responsibly as possible. I don't whine. I beleive we need to address the tranport issue... Responsibly! Stop the sprawl, redevelop blighted areas, promote light rail, and save just a little open space for the future and the health of our planet. It's not hippy talk, it's as much a reality as the transport iss

And what about the malarial swamp that only breaks free every winter. Surfers are greedy and in this case, it's now "their environment." So tell us surfers, what else is entrusted to your care?...Your oversight is needed on nothing. The exploitation of children in the pictures above say it all. No real parenting, but "friends of your children" to lead the charge. I hope all the sage brush is ripped out so we can get our roads freed up and not have the traffic as do the majority of people who commute on these roads. Surfers fall by the wayside. Pave Trestles now.
